Senate Republican Leader Bob Huff (R-Diamond Bar) states his passionate opposition to the use of a Senate procedure to pass part of the Governor's Drought Relief Package in his Capitol Comment for the week of February 24, 2014.

Senator Huff says AB 79 should have been designated as a two-thirds vote appropriation and urgency bill, but was instead designated as a budget bill, which allows it to pass with a simple majority vote. Senator Huff argues that passing a new budget bill, eight months AFTER the budget has been voted upon, adopted and signed into law, is a violation of California Proposition 25.

Proposition 25 authorized a majority vote on the budget and related trailer bills to be delivered to the Governor by June 15 each year. The intent of Proposition 25 was to motivate the Legislature to pass on-time budgets. Voters did not pass Proposition 25 so that the Legislature could pass budget bills on a majority vote eight months after the official Budget Act.

Sen. Huff, then why did you vote for this bill? When you should be putting action not just words into place. . Speaking against something isn't enough! And as long as your speaking I'd like to hear your stand on the Constitution and Bill of Rights. And more specific on gun control and gun ownership. And First Amendment rights! Two rights that we seem to be loosing at every turn

Ray, I voted for the bill because it is needed policy. I spoke against the process, because the voters expect a budget be completed by June, not have a "budget bill" taken up 8 months later that has nothing to do with the budget. The Democrats would have had no problem getting 2/3 vote, the threshold for a bill with urgency, but chose to call it a budget bill because that only takes a majority vote. This issue will eventually be litigated. I support the constitution and bill of rights, including 1st and 2nd amendments. I have been a gun-owner since I was 12.
